Please note that the products and services subject of this contract, related to the site www.shop-bimbivip.com, are provided by BimbiVip srl with registered office in Via Mantova snc Tuscania vt 01017 Italy. This communication is given pursuant to and by effect of art. 7 of the D.L. April 9th 2003 n.70. Users who complete the registration and accept the terms of this contract may access the site, without establishing any commercial relationship between the user and BimbiVip srl and may invite relatives and friends to make purchases. Art. 2 - Product prices and shipping risk
The prices of the products are specified within the site and summarized in the "shopping cart" relating to purchases decided by the user, as expressly listed transport costs and any other item cost charged to the user. The risk of shipping the goods from the BimbiVip srl warehouse to the customer, in the event of theft and / or damage, is the responsibility of BimbiVip srl and is included in the shipping cost contribution paid by the customer to the purchase. Any damage must be reported to the courier before the parcels are opened when the goods are received by the user, or as soon as they are found if there is no damage to the shipping packaging of the product, and must be immediately communicated to BimbiVip srl by registered letter to the address indicated in the present contract or by using the appropriate online procedure, within its own profile. Any risk of shipping for returned goods or in any case for shipments from the customer to BimbiVip srl, are charged to the customer. Any refunds will be made after the BimbiVip srl will be put in a position to verify the incident and within the time necessary for any verification with third parties in charge of transport.
Art. 3 - Means of payment accepted
The payment methods accepted by BimbiVip srl are payment by credit card, Paypal, cash on delivery, or payment by bank transfer. For payment by credit card the invoice will be issued at the time of payment. For customers who choose to pay by bank transfer, the invoice will be issued upon confirmation of payment. Orders for which payment will not be ascertained within 3 days will be canceled. Customers will receive a reminder of their order and can send the CRO / SWIFT of the payment made while waiting for confirmation to avoid cancellation. BimbiVip srl is in no way responsible for any rejected payments and for any kind of damage or inconvenience arising from the non-delivery of goods as a result of the failed or rejected payment or any cause not attributable.
Art. 4 - Times and costs of delivery of the goods
BimbiVip srl has been using DHL / BRT / GLS for years as a logistics service and delivery of goods, therefore one of these partners will be in charge of our shipments in Italy or abroad. Orders are processed and shipped to the Italian territory within 3/5 days of payment made. For orders with destination Italy below € 400, shipping costs will be automatically calculated and reported to customers. For higher orders with Italy destination are free, for all other countries the customer will be contacted by our customer service that will calculate according to logistics guidelines the costs of exact shipments. The indicated delivery times are for working days. BimbiVip srl delivers 100% of the products within 3/5 working days in Italy, if for CE and Extra CE countries delivery times will be higher will be announced during the purchase.
For purchases from abroad the shipping costs will be calculated based on the total weight / volume of the goods ordered and the costs will be visible and explicit on the site at the time of closing the order.
Art. 5 - Right of withdrawal
1. The buyer has the right to withdraw from the contract stipulated in terms of these general conditions, without any penalty and without specifying the reason, within fifteen working days from the day of receipt of the goods by the buyer, pursuant to art. . 64 and ss. of the Consumer Code (Legislative Decree 22.07.2005 No. 206). The right of withdrawal is exercised by sending, within the deadline, a communication sent to the address indicated in the art. 1 by registered letter with acknowledgment of receipt. 2. If the goods have been delivered, the buyer who has sent the withdrawal is obliged to return the goods by sending the goods within a period of no more than fifteen days from the date of receipt. The costs and risks related to the return of the products will be borne by the buyer, who must send them in a secure form with the necessary guarantees for the products to arrive in perfect condition. The only expenses payable by the purchaser for the exercise of the right of withdrawal pursuant to this article are the shipping costs of the goods to the seller. In case of payment made before the exercise of the right of withdrawal, the seller is obliged to reimburse the amount paid, within thirty days from the date on which he became aware of the withdrawal exercise.
3. The return can not take place under any circumstances if the products supplied have been clearly used. Art. 8 - Any changes to the contract BimbiVip srl reserves the right to modify these general conditions of sale without notice, being able to change, delete or add both the content and services that are provided through the site and the format in which they appear or with which they are represented on its servers. These changes will be effective from the time of their publication on the site www.bimbivip.com and must be accepted by the buyer each time he makes a purchase through the site www.bimbivip.com. The buyer also has the right to obtain the updating, correction or, when interested, integration of data, cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those of which conservation is not necessary in relation to the purposes for which the data were collected or subsequently processed, the attestation that the above operations have been brought to the attention, including with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible or involves a use of means manifestly disproportionate to the protected right. Finally, the buyer has the right to object, in whole or in part, for legitimate reasons to the processing of personal data concerning him / her, even if relevant to the purpose of collection, to the processing of personal data concerning him / her for the purpose of sending advertising material or direct sales or for market research or commercial communication. Art. 10 - Validity of the clauses of the contract The invalidity of one or more clauses of the present contract does not invalidate the same in its entirety.
Art. 11 - Responsibility of BimbiVip srl and the competent court BimbiVip srl is in no way responsible for any disruption that would make the portal temporarily unavailable, or access to it by one or more users. BimbiVip srl is not responsible for the malfunctioning of the sold products except for what concerns the warranty conditions and in any case the disputed damage can not in any way be higher than the value of the purchased good, net of transport costs and charges. accessories.
